Class Action Suit: Flashoptions.com

Well, I've had enough with flashoptions screwing me out of money. They misrepresent themselves completely and it's time for it to end. I invite anyone who has purchased a clip from flashoptions to get in touch with me [email protected] because I'm going to be working on a class action suit, (if there isn't one going already), against flashoptions.com. Aparently there are already about 47 other people who are pretty annoyed with them and I'm going to be getting in touch with them soon. Please send me an email if you have been burned by them. Make the subject line: "flashoptions class action" if at all possible because I'll be filtering it into a seperate email box.

Let's take these bastards down!

Yeah, it's malaysia. I don't know the logistics of it, but I do know that it can be done. They ripped us off, misrepresented themselves to us, and they are doing business in the US, so there must be some way to retaliate. I'm still waiting on a call from my lawyer. If I don't hear back tomorrow I'll probably call again.

I'm actually surprised at the response. I've had reletively few people that have actually responded to the post and other emails that I've sent, but maybe when people see there's really something going on it will start to come together. At any rate, please let other's who have had problems know as well. The more people we get behind this, the better chance we have.

actually.. i think that you can do something about it because they are doing business in the US.. there was a preceeding case that was something like this that involved business over the internet.. i'll havta ask my teacher.. (business law) i'll double check on it.

Business law:

From my notes, just because they advertised and accepted your money means that they conducted business within the united states and the US federal court district has jurisdiction over them. Im not sure the legal ways to get them here but thats up to the court. Because you are the party that was wronged and you would be the plantiff, you can bring charges in the federal court district closest to your house, or in atlanta if there going to have an office there - you home state is the most convienent though

you might be able to get a lawyer to take the case on (damn forgot the term) more likely in class action - one lawer covers eveyone with a % of that whole amount sued for.

But i know for a FACT that your federal district court has jurisdiction over them, regardless of the original country

Straight from my law book:

a site must offer some degree of interactivity (such as allowing persons to order goods from that site) to meet the minimum contacts requirement (the one that give jurisdiction)

its gets tricky with international law because everyone wants jurisdiction but the US kicks ass for its citizens.

I personaly have never had a bad experiance with Flashoptions. I've gotten what I've ordered from them, but I have a lot of friends who have been burned by them.

I just hope you get what your looking for and things work out. I'm a Paralegal so I'll start looking around and seeing if I can find out anything for you.

if anyone paid by credit card, to them

it becomes a federal fraud violation for money changing hands over wire transfer.

most likely, they will settle with you, provide whatever lawyer representing you, isnt a moron.

granted if you all sue for 200k, the settlement would look like 60k.

i highly doubt this would ever go to court, mainly because you can not necessarly harm flash, other than having their us business rights revoked

internet fraud

Go to e-bay and look for the internet fraud link. I bought a mis-reresented clip from JDM_Wholesalers from Anacortes, Wa and have filled a case with the internet fraud organization through e-bay. Good luck. It always seem to be true, "if it sounds to good to be true, it probably is". I wish all the best of luck in some sort of recovery. I may be a good idae to find out where their web site is being hosted and have it removed from the internet.

if this company was a corporation which it prolly was, all they have to do is file a chapter 11 or 12 ( can't remeber which ) and they don't have to pay thier debts and everyones screwed.. and the crappy part is they can still be open for business.. sux huh? the law sux chaos is much more orderly hahaha j/p

This is great advice. The hardest part of pursuing an internation lawsuit is going to be the fact that you have very little way of getting a hold of the person you are suing. All they have to do is pick up and leave, and you're left standing there with your balls flapping in the wind. The best thing to do would be to wait until they try to setup shop in the US. At that point, they will have had to go to the trouble to get a US Tax ID number, SS numbers for their owners, and all that shit. You can't do business in the US unless you are setup to pay taxes. And the only way you can setup to pay taxes is to provide some legitimate ways of being contacted in the event of fraud. Once the fraud is committed here, those dudes are in for some SERIOUS trouble, because the SEC and the IRS don't take kindly to people screwing around with money.

Anyway, much luck. I hate hearing about shady shit like this.
