indeed he does. Regardless of getting rid of a car if you get a ticket be it ref or not you pay the fine. As far as the new owner goes if a car gets a ref ticket and the person just pays the fine and sells the car the new owner is still on the hook to smog the car. Per California law smog is the responsibility of the seller. Though lots of people sell cars without smogging them and leave the burden to the buyer. Thing is very few people go back and tell the person they are buying the car from "hey you need to smog it". Usually because they get a deal on the car anyways.
