Thing is very few people go back and tell the person they are buying the car from "hey you need to smog it". Usually because they get a deal on the car anyways.

i talk to a buddy of mine (who has had numerous ref tickets) and he said that he has used the sale of a car to get out of a ref ticket. just told the judge he sold the car showed him a bill of sale and the judge dismissed it.
