Ok this is what I found for California.
California Motor Vehicle Code sec. 27150.(a)
Every motor vehicle subject to registration shall at all times be equipped with adequate muffler in constant opperation and properly maintained to prevent any excessive or unusual noise,and no muffler or exhaust system shall be equipped with a cut out, bypass, or simular device.

sec.27201 Motorcycle limit
The noise limit of 92 dbA shall apply to all motorcycles manufactured before 1970.
The following noise limits shall apply to any motorcycle manufactured:
(1) After 1969, before 1973 88 dbA
(2) After 1972, before 1975 86 dbA
(3) After 1974, before 1986 83 dbA
(4) After 1985 80 dbA

This is the law, as to why it is not enforced I can only speculate. I have heard from a police officer friend that " alot of cops ride Harleys and do not believe the law has merit, so it is not strictly enforced." Again this is only one police officer that told me this.
