Legality of swaps- RB engines legal!?

Ok and everyone thinks this is the same question that has been asked.
BUT I was thinking last night, if you have to replace an engine with a newer engine that was approved for US use, well, for isntance, the swap to an R33 RB25DET should be legal then?
Thanks to Motorex, the GT-S and GT-R (rb26 and rb25) are both legal for use in the US.
That one guy said his friend had a civic that he had swapped a newer integra motor into and he just got a plate that said it was like approved, well technically, I'm thinking that should work with a Nissan too. The problem would be that you can't use a JDM engine, you would have to get one from Motorex. However, I did see a wrecked whole car R33 GT-R up on ebay, a motorex one. So it wouldn't be impossible.
Anyway, people who understand the law better than I do, please comment.
