My car is gone.

I was driving home from school after dropping off my girlfriend and was going to get gas.I was driving up this street where I have no stop signs and this other guy in a 04 corolla ran his stop sign and t-boned my car. His front hit my passenger side door,rear quarter, and bented my wheels. The all happened on the rear passenger side of my car. I'm guessing they will total my car. Since we can assume he is at fault and he has AAA insurance, I'm wondering how I should go about either getting a new car or have them fix my car. I have all my receipts for EVERYTHING that I did with my car, tints, wheels, suspension. Now, if his AAA don't give me enough money, can i just have them repair it and declare it salvaged? Like, let's say AAA wants to give me $3k for my car and I don't accept the $3k but instead, want them to fix it, can I do that? I'm not sure how this works and I searched but can't find a direct answer. Thx for any help. Accidents sucks.

yeah, always get a lawyer when you have been hit and it was not your fault. You will get more cooperation out of the insurance company.

that happened to me on 4/24/04. some1 blew a stop sign 2 blocks away from my house and t boned me in my old s13. i got $4600. i fought with the other company and showed them all the bills that i had for the car. i also got to keep the car to part out and make more.

Receipts are a must.

Have photocopies of everything, also, if you have friends at a shop somewhere, have them write up "installation receipts" for most of your parts.

When my B16 Civic got stolen, those bastards at Liberty Mutual insurance told me i was getting nothing unless i could prove the B16 i submitted a credit car receipt for was actually installed in the car . . .

don't go thru his insurance,
a lawyer can get more out of it,
especially if there is medical involved,
more importantly, are you injured...

ok... i called AAA and they couldn't find his polic number or file or anything. So, what should I do now? Do I get money from MY insurance? Can I get a lawyer to sue him? I'm going to the emergency room later, just to take x-rays and check on my sore neck.

cut a deal with him if you know what i mean.

your probably gona lose your car to total lost.

ask for buy back. and then part out your car.

and start another 240sx.
or even get a step up from the s13.

Sorry to hear, but just want to let you know, when my 99 GSR with a JDM conversion got stolen, the insurace didn't pay for shit that I upgarded. Even when I have the receipts. They said that I didn't buy insureance for those parts, but good luck hope you get all you money back.

#1 i hope the police came and made an accident report. if so, you need to go to the police dept and pick up a copy of that report.

#2 i hope you got his information; i.e. his name, address, insurance ID #, etc. if you did, you should be able to claim under his policy. it depends on what it says in the report, and who blame is attributed to, or if you are in a no-fault state with percentage blame, etc etc etc.

#3 if the police didnt come and you didn't get any of his information... you might be SOL. if you have liability insurance only (as most 240sx owners do), your insurance usually will not cover your loss. liability only covers damage you do to other people when you are at fault.

i did get his information, actually the police came and helped us exchange info so i have a badge number and everything. they didn't do a report, but it was obvious who was at fault. i didn't have a stop sign, he did. his front hit my side. i mean, i cant slide my car on purpose to smash his front right? took pictures of the scene and of the 2 cars. i don't think he have any insurance and yes i am going to get my body checked and my insurance says if he doesn't have insurance, go to small claims court. So, i think im going to get a grip of money from him. i have his info and the police officer's badge numbers even though they didnt take a report. If i do go to court, I'll probably total my car and get money from him, or bring my car to a body shop to get it repaired, then send him the bill. any other suggestions guys?

If he doesn't have insurance, what makes you think he has money? You can sue but if he doesn't have money, then expect a along time to get it back.

If he has no insurance your best bet is to go to the doctor and claim injuries so that your personal insurance pays you. Its called uninsured/underinsured motorist coverage and you better hope you have it on your policy. As for your car, if he has no insurance and you have only liability you have a long road of bullshit ahead of you.

his insurance supposedly expired. so he HAD insurance, he has money im sure. well, i mean... he crashed his 04 corolla into my 240.

well i think im going to call the guy and see what he wants to do. Since he didn't have insurance + he ran stop sign + he was speeding, that could probably mean license revoked if i take it to court. I don't want to be hella fucked and have his license revoked so i'll call him and ask him what he wants to do. If he wants to settle outside insurance + court, then i will cancel the claim, and see what i'll do . But if he doesn't give me a reply, i guess i have to go to chiro and get checked out and have insurance claim it, then go to court and have him pay for repairs and what not. anything else or ideas i can do?

*STOP TALKING TO HIS INSURANCE COMPANY. NOW. Anything you say in the phone call will be used as incriminatory evidence against you. They tape RECORD ALL CALLS. HAVE A REPRESENTATIVE CONTACT THEM (IE LAWYER/ADJUSTER).

*Have your insurance company help you prove the damages. BUT DO NOT GET COVERD BY THEM. THEY MAKE MONEY FROM THE DIFFERENCE OF THE SETTLEMENT. Meaning, they will cut you a check for $1200, and get a check from his company for $4000, and raise your premiums. Use them to show proof of insurance, and to prove costs involved, but taking the "quick and easy payout" will hurt you in the long run.

**Get in touch with the guy in this thread, or a lawyer, and SHUT UP. The less you say from this point on, the less you incriminate yourself. If they call you, let it go to voicemail, and have their calls answered by your ADJUSTER.
