Question SR20DET in Cali and in the military?????

I've been searching endlessly and can't find a hard and concrete answer to my SR20DET question. So maybe someone can guide me on the right direction to where to look. So if I'm in the Military in California and have a SR in my car, can i be fined or REFed if I get pulled over and my car is registered in Florida???? Im sure this has been asked before but I NEED a definite anwer let me know guys, some good references need to be posted.

you are in a loop hole of sorts. since you are in the service you don't have to register your car in cali, and thus no cali smog. but at the same time a cop can still be a dick to you and mess with you for a while. although as far as i know he can't take your car cuz it's registered in another state!

Yeah, it's some sort of loop hole. From what I've been told military service members have one year from there report date to register their cars in cali. I know you have to smog your car to get CP base stickers. If your stationed here in cali and have florida dod stickers, you run the chance of have your DOD stickers scraped at the gate. Not everyone switches over to cali plates. Here is the link.

It says that you don't get a smog exemption, but it also says you don't have to pay the fees. It's not really clear. I would just call and ask.

I couldn't find a straight answer so I actually called the CHP HQ in Sacarmento a while back and spoke to an officer after call ing the CBAR which gave me shit. (Supposedly SoCal & Norcal are night and day but it better than hearsay)

You don't have to register your car in Cali as long as your in the military but you do have to smog your car in the state to get a DOD decal.Usually once or maybe twice depends how long your here) So technically you suppose to be following the state laws. Now if you get stopped he said they can write you a ticket and send you to the REF but you can just tell them you drove you car back and they can't do much to you when its time to show up. (Officers words) Actaully he was non bias, helpful and explained alot of things about why officers pull people with modified cars over.


IMO its a gamble cause even he couldn't give me a black and white answer.

Definitely not true. As a military member, you do not have to register your car in California. I'm on my second assignment in California and have never registered my car here. In fact, they tell you during in processing that you do not have to register your car here. You do, however, have to smog to get your DOD stickers. Recently, many bases have done away with the DOD stickers since we all have to show ID's at the gates. I'm stationed at LAAFB and I benefit from that newly imposed reg at our base.

Well I know that you will need to pass smog to get a base decal if you are in pendleton. I had my 98 S14 register on base before I got my swap, but then at last I had to register my car in Cali two years later because I didn't want to take my car back up to washington to get emission test. However, I do remember I got a ticket for my exhaust before with my Washington Plate off base(just a thought). Oh yea, good luck with showing your ID at the gate at Pendleton or get a temp pass, because MP are dicks and they will mess with you if you do temp pass and show ID for too long, especially if your car is real noticeable.

\As you stated, it's an imposed reg at your base. Not all of the branches of the military are the same nor are the all the bases the same. During our "processing", they state if you claim residency in california you have to switch over to cali plates within a year. Now that's our base/commands regulation. Having a CA ID and/or DL is establishing residency because in order to get one or both you have to have a CA address. The statement "Definitely not true", is not true. Check with your command and local authorities about getting fined or Ref'd though.

What you are saying is true if and only if you want to claim residency in California, as you have stated. No active duty military member has to claim residency in the state that they are stationed. I have always claimed Texas as my state of residency (no state tax, YAY!).

- the individual's home state or country or

- The license plates displayed on the vehicle are valid plates issued by a foreign jurisdiction.
- The vehicle registration and license plates are issued to the military person or spouse of the military person.
- The vehicle registration and license plates are issued by the foreign jurisdiction where the military person was last regularly assigned and stationed for duty by military orders or a jurisdiction claimed by the nonresident military person as the permanent state of residence.
- If the vehicle is a motor vehicle, the owner or driver has insurance.

NOTE: Military orders do not include military orders for leave, for temporary duty, or for any other assignment of any nature requiring the military person's presence outside the foreign jurisdiction where the owner was regularly assigned and stationed for duty.

I found some additional info from their website.

"Registration and Smog Laws

A car registered in another state that has no smog devices is legal to drive in California as long as it is equipped as required in the other state.
Vehicles are prohibited from emitting excessive exhaust and will be cited for air pollution, even if the car is registered in another state.

All new unregistered motor vehicles that are brought into California whose odometers read less than 7,500 miles must meet smog requirements and must be equipped with a California emission system before they can be registered.*

New Vehicles - a new vehicle that was previously registered in your state of residence or last state of active military duty does not have to be equipped with a California emission system.
Used Vehicles - Most used vehicles previously registered in another state must meet Californias emission standards before registration will be issued."

Jeez thought I told you wussup already. No you dont have to register it in CA, no CA has no jurisdiction on your car if its registered out of state. How the fuck are they gonna Ref your car if its not in the CA DMV system??? The only thing I forgot was the smog shit, yes you have to get a smog cert so the base will give you a base sticker. But guess what, if you go to a smog place and tell them you just need a cert for a base sticker and not CA registration, they smog you on a different category where its not as stringent as the actual CA smog test. Basically gives you alot more lee-way to pass it....

Or since its a DOD wide sticker, if you have one from youre old base and its still good, then your good. Ive had a sticker from Ohio when I was in CA, and guess what, IVE NEVER BEEN STATIONED IN OHIO!!!

After you change duty stations your required to changed your decal its only a matter of time before they catch you but the out of state smog requirements are dead on. But its still a grey area "the same way they make you smog will be the same basis for them having to ref you to CA standards. Honestly as mentioned before out of all the SR powered cars in CA how many have been stopped and reffed? Its a small percentage so I think most will be ok if they drive normally and stay of of hot area's.

I'm sure noone will find the answer in black and white if the CHP/CBAR couldn't find it.

Your doing the work yourself or having someone else do it?

If your not doing it yourseld ask around before you drop dough at any local shop. I'm seen some hanious(sp) work by "pro" shops for big money.

I'll come and supervise devil. Seriously I'll throw in a hand but I don't have any exprience I wanted to tackle my own but I was worried not being able to finish and having someone else unfuc my work.

Knew a buncha guys from Camp Pendleton. The trick they used... always having their miltary card w/ the driver license.
They would give the miltary card w/ the DL.

99% of the time the cops would let them go. 3 reasons - cause they used to be the miltary, because you just came back from Iraq, or because you might be a cop and end up being their boss.

Miltary guys usually get special treatment if they are respectful to the officer. Might as well take advantage.

i know this is off topic but i have a big question
im moving soon to florida and in PR i have a 90 fastback with redtop sr20det
simple mods like frontmount 3inch exhaust (no cat just a pipe from the engine to the muffler) walbro fuelpump and stuff like that (no emissions) and i still pass emissions here in PR... but i was wondering if i would have any problems in florida... cause if im gonna have problems im just gonna leave the car here...

Depends on where you go...there is smog in FL but its only on certain county. The county my car was registered on didnt have smog, but I was told up north, there's smog in certain counties...

This has always gotten me out of shit 95% of the time...Mil Id always with DL and registration...
