EGR BPT valve ? -Pic Inside

I have an EGR flow malfunction and I think the BPT valve may be causing the prob. It looks like it's stuck in one spot. The BPT vavle monitors exhaust pressure and then once the pressure reaches a certain amount, the vaccuum is applied. So what do u think guys? Does the BPT valve look normal or should I replace it?

Did you honestly need to consult a Nissan tech to find out if the BPT valve is broken? It seems obvious that the valve is in two pieces - or is there something i'm missing?
