GOT HIT!! Need Advice...Insurance people come in!

Ok so yesterday I was leaving school and the only way to leave my school is to go down this one long road that everybody takes and its usually bumper to bumper at some points but clears up very quick.

It was me and 2 of my friends riding in my car and we're going down the street and this truck ahead of me stops so I begin to stop. Almost as soon as I come to a complete stop I hear tires squeal and then BOOM. As it turns out a 16 year old girl (who i knew) slames into the back of my s14.

I get out of my car and so do my friends and she follows. Nobody is hurt but my car is kinda messed up. When she hit me it caused my car to run into the big ass truck ahead of me and does some bumper damage. My Navan bumper is dented in but none of the lights are broken or headlights and also my hood is a lil fucked up. Then as I go around the back of the car i see the rear end is pretty damn screwed up...I dont have pictures but its definetly messed up but I've seen a lot worse that have been fixed before.

Anyways we call the cops and they tell us we can pick up a copy of the report next monday or tuesday. The girl admitted it was all her fault to the cop and that sorda stuff.

We both have insurance I'm guessing she has full coverage but I only have liability. Her dad owns a tow truck business and towes my car to his place to be looked at by his insurance company and so on.

Well today the girls mom calls my mom and says they do not want to claim it on their insurance and is willing to give us $1500. Well I KNOW for a FACT the damages will cost more than that to fix so now im in a pickle what should I do?

Should I claim it on my insurance? I only have liability though and the accident was nowhere near my fault so will my insurance pay for the damages? Should the girls parents claim it on theirs since it was her fault?

Also If I claim it will it make my insurance go up? I know sometimes it will make it go up even if its not your fault but what are the conditions?

Thanks for any advice this really sucks. Also this is her first wreck and its my 2nd, my first wreck was my fault but this one was not.

Also forgot to mention but after I was hit tried to start the car but would not start. Also the transmission locked up and will not go into any gear just stays in neutral.

My friend helped me push it and the car, even though in neutral, would only move when the clutch was pushed down.

Since you only have liability your insurance won't fix anything from your car. Liability only covers the damages you cause to others. So the girl that hit you needs to report it to their insurance company and since she has full coverage her insurance should cover both of you.

It is not her decision to claim it on her inshurance...It is yours. If they do not want to give you enough money to not report it, then have your car towed to the bodyshop of your choice...one you know does good work, and have them fix it. The police report will state she is at fault. You have her inshurance that is all you will need to give the bodyshop. You will not even have to pay a deductable. The only real worry is if they total your car.
Now I may be wrong on this, but that is how I have always done it.

They told my mom they did not want to claim it on their insurance so if i can get their insurance information off the police report i can just give it to the bodyshop and they will charge their insurance company?

Man forget 1500 dollars tell her you want all the car repairs paid in full, it was her fault so if she decides not to pay up you could take her to court and sue her insurance company dont let them take you for a fool get your car repaired properly man,you have pretty much full control of this situation

Usually, you'd report the whole thing to your insurance company right away, especially if you were at fault. Since you don't have collision coverage (which covers your car), and your not liable (meaning you don't want your liability coverage to go up), you don't have to talk to your insurance. You call hers, tell them where you're taking the car (or ask if the place you want to take it "is on their list"), and they foot the bill.

If you want to be nice, you take the cash (any amount you feel is fair) - not their choice.

when she hit me there was also some engine damage as the car will not go in gear so should i take that into account to?

the lady basically told my mom today that she was willing to give us 1500 to get it fixed basically trying to pay us off.

The police report WILL say it was their fault because the girl admitted to it being her fault so do I have the right to make them pay?

get 3 quotes from different reputable shops(preferably the most expensive ones...) for ur car to be fixed.
as in everything that got messed up.

ofcourse u would have to ask her to tell her dad that u will need towing to get ur car some quotes...

then show them the quotes u got then tell ask them if they still want to pay cash or have their insurance take care of it...

if i was in your place. i wouldnt take that $1500 cash.

1. ill check all the damages and see if that $1500 cash will be enough to cover the damage. hood went it you never knew your rad support when in getting a rad support pulled back will cost you more than a $1k or they may have to replace the whole rad support. rear end is another prob and that $1500 she offered is not enough.
2. your car wont start up. engine needs to get check with damages on it and it'll cost you more if the mechanic found engine damages. MORE MONEY!
3. tranny is locked up. probably got fucked up when you got rear ended and your subframe went it and your driveshaft went in and hit your transmission.
4. dont let them decide what to do. i would decide since its her fault. i dont care even i will have a record as long my car will get back on the road with good running condition.

I would get quotes, if its enough, take it, if not, than dont. By the sounds of it, she fucked you up pretty good. Hope is fixable in the insurance companys eyes. Good luck.

ahh, sucks man. same shit happened to me on my first car, DSM, got rear ended and I only had liability. The guy told me he would give me money, but I would have to wait "a couple of weeks" 'cuz he was on probation for something and he didn't want to go to jail if I reported it to his insurance. The douche wasn't even carrying his license with him and told me to go to his house with him so he could show it to me. Yeah, right. So I only waited a couple of days for him to get me some money. Well whatever I notified my company and they got in contact with the dude's insurance and well, my car ended up being a "total loss". So I was like, f@#k it and just gave it to the insurance company 'cuz I was tired of it already and I ended up getting almost a grand more than I payed for it even after the "total loss" title.
Not trying to thread jack or anything, but yeah if your insurance company is cool, they'll got in contact with them. your options would be to take whatever they think your car is worth or they subtract a small amount from that and let you keep your car. thats what they offered me at least. good luck man.

You can usually buy the wreck off them, and their insurance 'should' cover you for the agreed price of your car, make a good relationship with the mechanic you go and see so he's less inclined to write it off. Was in a similar incident, with the transmission locked up and everything, its going to cost a pretty penny, 1500 will probably have fixed your trans and thats it.

Insurance is the way to go...

Here are your choices:

1. You can accept the check for the value of the car. And the insurance company takes your car away. (I was offered $4400)

or

2. Take the check and ask to keep your car. I cost me 600 to keep mine. Keep it if you think its worth fixing, or if you think you can get some extra money out of it by parting it out.

My car was salvaged because some one broke all my windows, headlights, and stole my stereo system, and side skirts. The damages were more than the actual value of the car. Thats why it was salvaged. So I kept the car and $3800 from the insurance. It was worth it to me. I had a 95 240sx base model.

what ever u do do not take the 1500 dollars, its there fault they should pay the full amount to fix it, u break u buy.. lol

i had this exact same thing happen to me like 2 years ago, i knew the person felt comfortable trusting them, and did not report it to my insurance, next thing i know they dont even pay me the full amount they said they would, and i got screwed

your not at fault, you need to get fixed what THEY damaged, there just trying to take the easy way out, so they dont have there insurance go up.

from the sounds of it, your car seems like its going to be a lot of money to repair, i have no clue the exact amount, but i know its up there probably more then what your car is worth

Do not decide, she is at fault and her mom is trying to screw you. You tell her mom you want everything covered or your going to sue. No decision here just action on your part. Yea dude their really isn't anything to be confused about. She is at fault, you have the police report, and she has full coverage. You get in contact with her insurance company and let them take care of it thats what insurance is for. Find out how much it will cost to repair the car from other shops as her insurance company will do the same.

congratulations you are about to get PAID!!!! Do not take the 1500 you are not at fault she hit you. If it was the other way around your screwed on fixing your car. Report it to your insurance and she needs to do the same. An adjuster will come and check the damages dont let him get to you saying if your vehicle is involved in racing and etc especially if your car is kinda fixed up. (they done that to me once before) have receipts for everything you got on the car if you got some performance mods etc that could have been damaged. thats more money in the bank as well. Theyll fix your car and DO NOT SIGN ANYTHING GIVING YOU ONLY A LIMITED AMOUNT OF MONEY TO FIX WHATEVER. You make sure everything is a ok and if she has full coverage her insurance company should offer you a rental car till yours is fixed also dont worry after everything is paid in full since you have insurance as well you will get money for pain and suffering which is a bonus. Spend it wisely. hope this helps.

And if you know someone who works in auto body you can really get the sweet end of the deal. Most of the time you can just ask them to mark it high and some places will.

Remember we live in MS. There is no list for the insurance companies to give you. You are allowed to take it to whoever you want to in order to get those estimates. You are literally in full control of what happens in the end here.

Fuck the $1500, if it was $15000 maybe. she can get into a shitload of trouble for not reporting it.. if there is already a police report you gotta report it.

Bro, odds are if the back of your car is fucked and your tranny is fucked and it wont start, they are going to total your car. That's a good thing most of the time.

hopefully her insurance is chill and lets you buy it back for cheap. i've had 2 cars totalled. one wanted $500 and one let me keep the car for free! (GMAC)

also if you feel any sort of pain or any of your friends do get it checked out, her insurance will pay for pain&suffering too.
