Exhaust ticket question. SEARCHED.

I got ticketed for modified exhaust.. it was marked as being not correctable.

However, The cop wrote down that the car was an "89 nissan 20s".

It's a 90 240sx coupe.

Do I have anything to go on here? I read somewhere that someone had their case thrown out due to the officer incorrectly noting what kind of car it was.

I am just looking for anyone's input on the situation and any help in not having to pay for the ticket...

I apologize if this has already been covered, I did my best to search.

I'm not sure, but I don't think getting the model of the car would get the ticket dismissible. I don't see how a exhaust ticket can NOT be fixable or correctable. But I don't think its a moving violation, so I assume you just have to pay the fine. & since I dont' think its a moving violation it won't get reported to your insurance.

No, you have nothing.

you put something ILLEGAL on your car, don't bitch when the law catch's up with you.

you could bring that up to the officer but he will say oh it's a mistake..... that doesn't make your exhaust any quieter.

i'm assuming that's that case if the car is a 240sx and he wrote 1993 Honda Civic. but he a Nissan 240sx to a Nissan 20s yeah not gonna happen.

First of all.. It isn't illegal if it's less than 95db. I'm pretty sure that it is under the legal limit although I have not had it tested.

I don't understand how she would think an exhaust violation would be something I could not fix and get signed off. Is this the norm when people are being cited for exhaust violations and I will just get a fix it ticket in the mail?

You'll still have to pay a fine, but you need to get it checked out by a state ref to show that the exhaust is in compliance with the law.

your ticket is no where near what the court would consider an incorrect citing. if your information was wrong, year on the car or make of the car then you would have a chance as you could have a case against the cop being fit to do his job correctly that day.

Well as I stated, she incorrectly put the car as an 89 when it is in fact a 90. It states this on both the registration as well as the proof of insurance of which I provided to her.

Also she did not bother to even take down the model of the car correctly.

Give it a go and see what you can do. I glanced over the year issue, didn't see she marked it wrong. Just read the 20s part. You might have a chance if you choose your wording and explanation carefully as to why you feel that would prove she was unfit to do her job and in doing so wrongfully gave you a citation for your exhaust.

Your assed out...pay the fine and move on. Cali changed their noise decibel shit, the 95bd crap is null and voided a while back. It is now up to the officer's discretion to deem it too noisy (aka fuck you in the ass with no vaseline).

This has been covered a few times in the CA region forum I'm sure but this is what you have to do (I had the exact same ticket.....for whisler tip LOLs)

Anyhow you got to a BAR-ref or whatever its called you can search where to go for that and you get the exhaust checked.....usually by appointment only and at community colleges. They test it, if its under 95db you get a printout saying you passed. Take that to court, the bailiff says he has you say you are guilty but you have it corrected and pay the $10 fine, or $25 if it went up this year. My bailout for the ticket was like $800+ so I said I'll just go through the hassle for having the "whisler tip" on my HKS Hi Power.

Just wondering where you found out that the 95db thing was null and voided? Also it has always been up to the officer's discretion to deem it too noisy or not, the 95db thing was just so you could do something about it after you got a ticket.

Nope the 95dB is still in effect, and as far as I know always has been. What has changed is that officers can now just pull you over for suspicion in violating this law.

As someone stated earlier you just have to go to the state ref to get it cleared. Really easy and free. Had this happen to me a month ago, and had to stick my stock exhaust back on (Apexi N1 was running 124.4 dB due to an exhaust leak). I put the stock one back on because I didnt want to hassle with it anymore and just wanted to get it done with.

Court date is in a month where I get to complain that it was total BS, and pay my 25 dollar fee.

Was it marked as correctable or non correctable on your initial ticket?

Will I just not know until they mail me the actual ticket?

Oh and my HKS Hi-Power with 2.5" piping on a stock KA24DE with stock cat ran a 85 dB at 4k RPMs, I'm not sure how 3" piping with most exhaust would run on our cars.

It says on the ticket under the box that says correctable. If they check it then you can just take it to CHP and they sign it off. If its not checked then you have to go to a ref. That is how I interpreted the violation when I went through this process.

generally if there is a decrepancy i will fight the case. I had a ticket thrown out because the cop wrote the time down on the ticket, but in court he gave the wrong time, he also wrote the wrong address for the area where he cited me, and where i actually was seen "driving with no lights"
anyways, you have a modified exhaust ticket, you're gonna have to see the ref, and he's gonna check EVERYTHING, so if your not all stock, your screwed. as for it being an 1989 and getting away with it, you never know til you try.

I've gotten a few of these tickets. All my tickets were notated to take the car to a state ref which I did. Did the paperwork to get the DB testing done and paperwork to submit back in court.

I'm suprised it's notated as not correctable, but keep the state ref paperwork in your car so the next time you get pulled over the officer won't give you a hard time. If you modify your car here in Cali you have to expect to get tagged by cops here and there...Good luck.

Isn't that a fairly cheap ticket?

...and I don't think that 95db thing is in effect. Last time I was pulled over by a lady copy in a charger she mentioned I had a modified exhaust (didn't give me a ticket for it though), I told her it is well under the 95db noise limit and she responded with "any exhaust that looks modified I can give you a ticket for". I have also been told that by another male officer at another traffic stop.

California's Modified Exhaust Law
the laws have loopholes so even tho its 95db, they can give a modified exhaust ticket anyways

California laws are definitely really weird. I got an exhaust ticket a long time ago because I had a muffler welded on to stock piping. When I pointed this out to the officer he said "any modified exhaust is illegal" and gave me a ticket. At first I thought this was just a mistake on his part, because he looked pretty young. After looking through some emissions laws I did find a section that said any modification made to a car's exhaust system is illegal. Anyway, I put on my friend's 100% stock exhaust on my car, because I had heard of many people getting their exhausts checked by a police officer and their tickets written off. I actually found a cop and got him to check my car and sign off my ticket. When I sent it in I got a letter back saying that it was a non-correctable violation and I ended up having the pay the fine anyway.

If you think about it though, what if someone jacked your exhaust and you had to get one made at a muffler shop? Wouldn't that qualify as a modified exhaust system and therefore be illegal? Wtf is going on in Cali...

lol cali cali cali always postin for exhaust tickets..got to pay to play in this state i hate it but usually modded exhaust means you got to slap the original exhaust system on lucky i got a DB test rather than modded exhaust i slapped the silencer and passed good luck i got the stock exhaust if you want for $100 painted black high temp paint looks legit LMK
