I live in california and I wanted to avoid getting the car "smogged" every two years because it sounds risky to me.

I was thinking of buying a datsun 510 with a sr20det swap because it is pre-1975.

However, I always liked the looks of a s13 or s14 and it should be more reliable because it is newer but it wont pass smog and it seems like smog is getting more strict with star stations etc

This would be my daily driver so that is important to me. Which would you pick and why? Any other car you would suggest under 8k?

I'd suggest you make up your own mind. Asking strangers on the Internet for their OPINIONS will get you nowhere. Might as well ask the hobo on the corner.

I want a 240z to replace my rx7, but I may hold off on that project.

With a S13/14 now a days, I would be more worried about theft than smog tests. You should take more measures into anti-theft... Don't be a fool without any form of alarm, kill switches etc. Getting pulled over by cops is another thing, I had 2 ref tickets with my old sr20 s13..

Oldschool gets my vote here, but you gotta consider that well its old, expect to spend more time hunting junk yards (well that is fun actually) and if you ever get into an accident you would probably get hurt even more as crash protection back in the day is minimal.

With both cars, expect times where the car is down for replacing parts, so a 2nd car or additonal transportation is always nice.
