What's illegal is putting a older motor into a newer chassis...

Basically, all the smog equipment has to be hooked up-that's all.

No its legal. You need to use all the original smog equipment on the DE motor, if its an OBDII motor you need to use the ODBII ECU, check engine light needs to work, diagnostic plug needs to work. Needs to pass smog test (smog II test so its on a dyno now) and a visual inspection at a BAR station where the ref (if you pass) will give you a sticker for the door jamb which says the car has a motor change, motor number etc.

I hope I'm not forgetting anything. You can find all the info on the DMV's website

its legal but putting OBDII in an S13 would be a pita.
I don't know anyone that has done it.
You could just toss the S13 intake manifold and such onto the 98 block and hope no one notices that the block's # doesn't match.

Diagnostic Plug

Is the Diagnostic plug required to be working if the engine isn't obdii equipped, such as a 92' DE? I would like to know since i swapped in a DE from a 92' into my 89' fastback. I spliced the engine harness into the enginebay harness, the result of this being that the the consult(diagnostic plug of the s13's) doesn't work anymore. The last thing i want to be doing is paying $200 to illegally smog a fcking KA swap.

yeah everything has to work.
you must maintain ALL smog equipment from BOTH engines, and when it is redundant the standard defaults to the LATER engine.
