personally i'd keep it...if they call...then make the decision to return it at their expense...or pay for it at that time if you decide you want it...being lazy and not taking the initiative to call them is not a crime...there is no legal action they can take at this time..they refunded your money..there is your proof that you canceled the order...they sent you the exhaust...you didn't steal anything...it was obviously a mistake but it wasn't your fault or because of something you did that the mistake was made...it's 100% on their end...

i'd be pissed at your friend's mom...tell her to give you your money back and you'll handle it..

you are assuming that once they notice and notify him of such he still refuses to pay them or return the product...i would hope this is not the path he chooses...but it is the only one which could lead to legal trouble..at this present time he is in violation of nothing at all...shit, i sign for packages for myself or my house mates all the time not knowing what they are...

I'd come forward without them asking and give em the money. Don't be a dick and do the right thing. You wouldn't want to be on their end and have to eat that much money. If you don't want to pay for the exhaust, at least let them pay for you to ship it back to em.

Being honest is the way to go. If you aren't, it WILL come back on you down the line. Also, it may come back on your friends mom, could get ugly in the courts and just be a plain mess if things aren't cleared up right away.

A more proper response from luisgonz would've been to report zanos's post, and reply to zanos (via PM or the thread) that namecalling isn't necessary, as he's merely sharing his opinion (albiet in a forceful and preachy way).
Since he couldn't seem to control his temper, that didn't happen.

As far as the other pink usernames are concerned, I mainly did it to demonstrate to othe users what luisgonz was having to face for the next 3 months. holisticbeatz has already been reverted to normal, and xxjapXXXXwhatever will revert in a day or so.
The whole 'pink username' thing is a new feature that I think was added after you stopped being a mod.
The basics are as follows: users are restricted to Chat and Tech Talk, have no PM function, cannot post new threads, cannot edit their profiles, etc.
If you want to try out a 'pink' username, PM me and I'll send you login info for the demo account. (drifterx only - anybody else asks, i'll delete your pm and make you pink for a month! )

if this goes anything like credit card chargebacks,

the customer will issue a chargeback, and the credit card company will issue it if it falls by visa/mastercard rules and/or regulations. the company will be issued a chargeback and documents relating to the chargeback. basically explanation of why and when it will be chargedback to the customer account. the company in turn will issue an explanation of the situation and maybe get the decision reversed.(yea...sure)

as for getting sued, i think the chances of that happening are slim...(i think small claims court is about $300.00 minimum for loss) but the person getting sued would probably be your friends mom.(it's her account) and by having a signed signature for the item doesn't really do much, cause i've heard of people getting computers by doing chargebacks on their card after signing for their computer through the shipper(ie..ups/fedex)

receiving product without paying for it is good for you. but it just comes down to your own morals.

btw.. it does suck for a business to get chargebacks. think how you'd feel if a customer charged back their entire receipt for a ONE dead plant... it's just f***** messed up.

oh almost forgot....
they know about it by now i think. mainly cause you only get one week to gather your information to fax/send back to the creditcard company. or they make you resolve the solution with the customer...(most likely they have to solve the problem with you.) so whether or not you get sued will probably be up to the company...

just don't be surprised if the sheriff and/or courier knocks.
