Bro, odds are if the back of your car is fucked and your tranny is fucked and it wont start, they are going to total your car. That's a good thing most of the time.

hopefully her insurance is chill and lets you buy it back for cheap. i've had 2 cars totalled. one wanted $500 and one let me keep the car for free! (GMAC)

also if you feel any sort of pain or any of your friends do get it checked out, her insurance will pay for pain&suffering too.

I dont know how they do it in Cali but that is not true..a police report is simply to just state what has happen and that in the event you deciede you dont wanna go throu insurance you have 30 days to make a full report/claim whatever..it is your choice to go through insurance or not. its a matter of choice. My gf just got her 2008 altima coupe hit it had like 84 miles on it..we got it a few weekends ago and like 2 days after that an old woman hit it. the damages where about 1200 bucks. we made a report so that the old woman couldnt be like "see ya later" and not pay. but we were doing this without getting insurance involved. so you deff dont have to go through insurance since u made a police report.

Well he is Mississippi and I don't know how they do it there. Technically in California, if your in an accident with over $750 damages and you do not report it to the DMV, they can suspend your drivers license for failure to provide proof of financial responsibility. Now if there was no police report he could indeed do what you described above in California or any state. Though in California and I bet in your state and his state as well once there has been a Police report filed the DMV is linked into it via computer. At which point if a insurance company or you do not file a report with the DMV, its license suspension time(for failure to provide proof of financial responsibility). The filing is called a SR1P in California and its a law.

yeah its deff not like that in Jersey..litteraly it happened about 2 weeks ago..cuz the car only has about 400 miles on it..so it couldnt have been that long ago..anyways..when the cop came down to come check out the accident i asked him if i make this report will i need to contact my insurance or the old womans who hit my gf's car?..and he said no its up to you guys however you want to deal with this. so idk man i guess Jersey "state of the highest insurance rates" lol isnt as harsh as Cali is..well either way I hope this kids car gets fix and this matter gets taken care of..i hate accidents..more importantly i hate not being able to drive my sporty 40 haha..take it easy man

My friend backed up into my car.. qtr. panel had to be replaced. Purely cosmetic. he reported it to insurance a month later.. Geico came by, and 2 days later..a check came in the mail. never even asked me where i was headed, nothing. I took the check, cashed it. went to a shop of my choice, and paid them in cash. the only thing insurance knew was that i received 2200. there was some money left over.. i wont say how much. at any rate... head to as money shops as you can.. i visited about 8.. quotes anywhere from 1400, to 4500 dollars.. average range was 1700-1800. everything turned out great. car handled amazing after the qtr panel was replecaed. coincidentally a new pair of largus bars found there way onto my car, and both my windows worked. wink wink wink.

sounds like they are just trying to get out of it which is understandable there insurance will go up a bunch but still like you said if it doesn't cover the cost of the repair than forget about it.

option A: have them pay for all the repairs to your car including engine repairs
option b: make a claim on her insurance and have her insurance cover it completely. when my mom was in an accident very similar she was hit from behind and tapped the person in front of her an insurance agent came out and estimated the cost to get her car repaired she received the money and got the car repaired.

I'd personally go with option b I wouldn't take a chance of option a and forget about the girl we all know what your thinking.

Just had someone hit my car in the parking lot... good thing i was there to see it otherwise they probably would have tried to leave.... I just reported it to my insurance company, then they got in contact with his insurance... his insurance then contacted me directly for pictures and told me to pick any shop that could do the work... his insurance is paying for it... that's the way to go... dont accept any cash offer period

GET YOUR CAR OUT OF HER DADS STORAGE YARD, storage fees can kill . Has the owner of the truck you hit contacted you ? If his truck was damaged i would expect a call from his insurance company. Now, if it wasn't damaged call her insurance tell them You were involved win an accident with one of their policy holders. Then go to the best bodyshops around and get estimates fax them over and wait for the to either declare your car a total loss, which you can buy back for +-$500. or get a nice check. It will more than likley be declared a total loss because its an older car and it has suffered both body and mechanical damage. Oh yeah this is the time where you dig up all of your invoice for work that has been done to your car. G/L

When I got t-boned in the corolla and the fender, sideskirt, and door was lodged into the tires. The other guy kept saying shit like, "oh yeah that'll buff rite out." Well whatever he called the next day asking to see the damages on the car. I said no cuz he was probably wanted to make up a story based on where the damages was. Anyways, filed the report and my deductible got waived. All is good.

1. Tell her $1500 and a BJ will do just fine
2. Recieve $1500 and Bj
3. Walk away saying " I also want full coverage from your insurance and if you refuse to do so ill have to take legal action "

Its a win win for you

I'm sure the fact that you know the girl doesn't make it easy to do this, but your car is gonna cost more than $1500 to fix, and the accident wasnt your fault, so their insurance needs to be the one that pays so you can get your car back to the way it was before

Here's my advice as an insurance agent. Easiest way is to report it to your insurance company. Its your insurance company's job to work for you. You won't have to worry about any hassles. Your insurance company will pay for your damages and then go after the other insurance company. Its called subrogation. It won't raise up your rates or anything because its not your fault.

This is the best route to go if the girls insurance company gives you any hassles. The girls insurance should cover it seeing as how she stated she is at fault. You need to get the car in a body shop fast though. They will not start working on the car until an adjuster (from your company or hers) comes and signs off on the repairs.

This is a simple process and you shouldnt let it get to you. Just make sure your car is in the same condition as before if not better.

thanks for all the suggestions but i think i have decided what i wanted to do.

To get the car fixed would cost a lot and i dont really want to get it fixed again. I called a few banks and got a quote as to what the cars retail value was and they all said $4200.

I've talked to the guy and he said he would give me 3000 and i keep the car. But then he put my car was a base model in his online quote which gave him 3800. My car is actually an SE and is worth 4200 according to the banks down here with the miles it has (210000).

Since it was his fault I'm not going to settle for nothing less than 4000 and I keep my car. If the guy feels its not right I will show him all the bank quotes i got them to print for me and also give him the quotes a few body shops has given me (which were aboslutely ridiculous lol) and I will tell him to pick from the two. If he still denies I will tell him "fine I will just have your insurance take care of it for me...have a nice day!" Im not a dick at all and I hate to be in this situation but I refuse to get fucked by people and will not stand for it.

With that being said my car is a 95 zenki with some nice parts on it. I plan on getting the car and the 4k sometime this week. I will post on here as well as a local forum with the complete part out of the car. Make somewhat decent money off that (hoping to get at least a grand total from the part out). Take that money and bank it with the 4k plus the other grand or so i have saved up after bills and what not.

Buy my friends NICE s13 for 3000 (silk road coilovers...new bushings...brembo rotors..hawk pads...cusco front and rear strut bar etc. etc.) Save up a lil longer and buy a RB or SR and build up whichever one somewhat and drop it in.

Sounds like a nice daily driver to me.

Somebody backed into my car and cracked my bumper and pushed the fender a bit. I reported it to my insurance and they contacted the guys insurance. He owned up to it so they told me to get quotes. I got them and they told me either i take it one of their shops or i take the money. I took the money and fixed my bumper and fender myself.

Similar situation happened to me. I was rear ended while I wasn't even in the car. Some people saw the car that hit mine and took off and by sheer luck I found them. The girl that hit me immediately admitted fault and gave me all her contact info and insurance info. I didn't call the cops but I filled out a police report and met her and had her sign it.

The next day her father called me and said that he didn't want to deal with insurance and that he'd pay me out. So I got an estimate from MY mechanic and told him what it was. He thought it was too much (which was amazing since he didn't see my car) and that he wanted me to take my car to his mechanic to get it fixed. The beauty part is that in TX there is a law like in most states that says that if your car is damaged you can take it anywhere you want to have it repaired. So I said screw him and called his insurance company. Took it for an estimate at one of their people and guess what...they came up with the same number that my mechanic did. The next day I got another call from this girls dad and he wants to pay so I tell him F**K you you had your chance to do the right thing.

Bottom line...your insurance doesn't come into the equation AT ALL...even if you have NO insurance. This girl hit you and pushed you into another car. It is her or her guardians responsibility to be financially responsible for the damages caused to your vehicle and the truck she pushed you into. Do yourself a favor and call her insurance as soon as possible and file a claim so you can get a check to get your car fixed. If there is also transmission and engine problems then there is NO WAY that $1500 will cover all the repairs and there's no telling what might be uncovered once repairs begin. There could be suspension damage from the rear hit, airbag sensor damage from the front impact, radiotor crack from the front impact, etc. You don't have to worry about your insurance that shouldn't have to pay for anything!
