To Lieutenant:
Over a month ago on February 7th, 2008 at 4:12 P.M I got into a vehicular accident, accident # 212. What happened throughout the accident went as the following: I entered the intersection at a green light waiting to make a left turn onto Peninsula Boulevard from Fulton Avenue. The traffic on the oncoming side came to a stop and that is when I realized that the light turned red. I proceeded to make the left turn being that I was in the middle of the intersection. That is when the other driver ran the red light and hit my car. When we got out he smelled of beer and ran away on foot leaving his car at the scene. In the passenger seat of the other vehicle was a case of beer and a couple of open beer cans. His car also smelled of beer. I dialed 911 and that is when they sent officer Murphy. He took notice to the smell and location of beer in the passenger seat immediately when he came to the scene. Murphy asked me what happened and I told him the story that I told you above. He insisted that I ran the light and that’s why the accident happened. Officer Murphy and the other officer, who I do not know the name of, located the other driver in Burger King which was a few stores down. They told me to wait while they get him. As they were saying that the other driver ran away, yet again. Murphy told me to wait in the parking lot and I did, for an hour and thirty minutes. He didn’t show up. I went to the police station and asked for the police report and I got it. That’s where I noticed a couple errors. On the police report it said that my point of impact and location of where most damaged was received was 12, which is the driver side fender. As you can see in the pictures attached, my driver side fender was not touched. My passenger side fender was the point of impact and that is where the most damage was received. How can I come into collision with another driver if it was my side that got hit? I called my lawyer and he told me that when you enter an intersection on a green light you can leave on a green, yellow or red. I drove back to the police station the same day as the accident and I told him what I felt was incorrect with the report. I then asked if he can amend the report. He refused telling me that everything he wrote down was correct then insisted that I wasn’t in the middle of the intersection. He followed that statement by saying, even if you were in the middle of the intersection, how can you tell that the light was red if it’s above you? I told him there’s a light on the corner and he called me a liar. Yes, a liar. I felt insulted. I took a picture of the corner light and it’s attached to show you that I am indeed no liar. My insurance company told me that an investigation was not done on the accident. I do not understand why. My lawyer and I feel that I have a strong case. I feel that officer Murphy did not do his job on this case and beared prejudice towards me because I am 18. I would greatly appreciate it if you had a talk with him. Sounds good, however it sounds you about to fight a battle that doesn't seem like you can win. It sucks but its the truth.
I say go for it though, what do you have to loose. And why isn't your laywer writing the letter?

it sounds like you're doing the right things. Did you get a gander at the driver as he left? Can you identify him in court if it's the same person? Bring the pictures and the police report and point out the errors in the report. I wouldn't stop until the report has been changed. It doesn't matter if you ran the red or not, I think, if the driver is drunk and has been consuming alcohol then HE'S at fault. Take some pictures of the intersection and bring them to court. Maybe get a written statement from Officer Murphy, if he's willing to explain his side and attempt to debunk his statement. Don't try to make him look like an asshole cop, just an honest mistake.

yo man it was he owner of the car that hit you, and thats messed up. he knew he was drinking so he flew the the scene so he wouldn't get hit with dui. then he reports his car as stolen so he can say he wasn't driving and get away with murder. i dont about going on the peoples court, but i wouldn't take this lying down!

So I went to court and the defendant didn't show up for the first 15 minutes of the first calling. I was thinking "YES! Easy money." Than out of nowhere some guy in a suit walks in that everybody who works there knows. They all greet each other and after that he's like "I'm here for Joseph Wedemeyer." I'm like....****. Then he say's I'm adjourning it for next month, then he looks at me and says, "Can I have a word with you?"
We step out side and he says, "This is how it's going to work." In my head I'm like, oh god, one of these guys. He goes on telling me about how I'm not going to get anywhere near the blue book value for the car because of the police report. I cut him off and tell him 'This is where you're wrong. I wrote a letter to the lieutenant of the police department complaining about how I was the only character at the scene of the accident and what I told the officer wasn't written on the police report. I guarantee by next court date the police report will be changed to my liking.' The lawyer then said alrighty, I'll talk to the insurance company and see if they can give you the bluebook value. I tell him that I have receipts for everything that I fixed on the car and he said I highly doubt you'll get anything for that. At the end he basically gave me a deal, either 2,650 from insurance for blue book value or see what I can get from court for 5000 (What I'm suing for.) I told him to call me when he talks to the insurance company. If the insurance company offers me $2,650, I'm going to take it. What do you guys think? I have receipts for all repairs done to my car which add up to a total of 5,585. What do you think? |

And I don't think his illness would prevent him from owning a car, but I would think it would prevent him from having a license. He may just get driven around. My mom went through a similar situation. The cops where chasing some guy, the guy lost control and hit the back of my moms 91 Honda Accord station wagon that was parked at her friends house. The guy jumped out the car and fled through the neighborhood through some yards, the cops lost him since it was at night. The driver was never identified, and the car was stolen. We said screw it and left the car as it was. We hammered the latch a bit back and got the hatch to close. There wasn't much we could do. Its one of those cases where your just stuck. If you cant sue the guys insurance, just drop it.

Sorry, didn't see that. Your going about it the right way to take the money from the insurance company instead of the guy. I'd take the $2650. I'm assuming you got a nice paint job and body work anyways. Any pics of the car post body work?

OMG why would you even ask this question?!? I would've been on tv by now hahaha. But seriously good luck, it sucks but the truth is that you're at fault whoever is turning must give way to those passing through the intersection (even if he did run a red), but since the guy was drunk that could change the judges mind to your side. Let us know what happens.

christ, there is going to be an episode of south park making fun of this whole thing one day. i put $5 on it. its the perfect set up if you think about it, it involves drunken retards and auto collision lawsuits.

Yeah. Everything is done with already. I'm waiting for $2000 dollars in the mail. I have my new 240 and everything. It's staying stock till I get money/career job. So that means stock for another 2-3 years :-D. Meanwhile this summer I'm taking some investing class for the hell of it. Then I play with stock market til I become a radiation therapist :-D

you should really look into becoming a lawyer, for your age, nothing against it, you seem to be very mature and know how to properly handle business. I'm glad you at least got something out of it.

Thanks punxva but from what I hear, the schooling for that is so long. I'll lose motivation half way through. With radiation therapy, I just have to go to school for 2 years (or one, depending if I want a certificate or degree; I want a degree.) Then once I become a radiation therapist I'll be making 65k minimum, that is IF i find a job. And while I'm working I'll go to school to become a physicist, get promoted and boom.
But what I really want to do after saving up the money from radiation therpay, is make my dads auto repair shop grow and do something in the automotive industry. Mainly because my dads a mechanic (owns his own shop) and my brother is going to school for it. My brothers making a name for himself in New York. If any of you guys heard of C-LO Tuning, thats him. I want to build a company off of that so it could be a family business of $$, sorta! Just a dream... lol I need someone who's knowledgable in business to talk to. I have so many ideas in my head and I want to know if any of them would work. |
