You ever heard of "The People's Court"

Well if you remember my accident. I got hit by a drunk driver who ran a red light while I was making a left turn. The insurance company put me at fault and refused to give me money but, my lawyer said that I should be getting money because the other guy had beer in his car and he fled the scene of the accident. The vehicle was reported stolen at 10 P.M that night, the accident happened at 4:12 P.M.

Since no one knew who the driver of the vehicle was my lawyer told me to file a small claim against the owner of the vehicle and I did. The KBB of a 93' s13 SE is 2,700 and with all the receipts of the repairs done to my car it is a total of 5,585 law suit. I recently found out that the owner of the vehicle is mentally handicapped.

I filed it and my court date is on April 7th. I JUST received in the mail a letter from the famous tv show, The Peoples Court. They are asking if I would rather be put on that show instead of going to a small claims court because they are more beneficial to me.

I don't know what I should do. Should I go on tv or just go to the small claims court? I talked to my girlfriend and she said that the judge is an ass and she has to be an ass to get ratings. Now my thinking is, I'm suing a legally retarded guy for 5,500 and I'm 18 years old driving a sports car. She's going to attack me?

The owner of the other car can't be too retarded to own and maintain a license.

They asked me to do something similar with my claim against a car shop. They were going to fly us out to Texas and all this stuff and guaranteed payment within 14 days of the judgement or something. I said no, it's not worth the hassle.

I would go on the peoples court. Get some acting lessons and win that case. Member to mention zilvia on there too so we get some spotlight! Not sure how to do it here an example.

They put me at fault because the police report said that I failed to yield the right of way. This is what happened at the time of the accident:

I entered the intersection on a green light waiting to make a left turn. I saw that the oncoming traffic had stopped and I realized that the light turned red so I proceeded to go, otherwise I would be in the middle of the intersection. The driver ran the red light and hit me. He ran away leaving his car and he reeked of beer. There was a 24 pack of beer in his passenger seat and open beer cans (This is in the police report.)

The police report states:

MV#1 was w/b on fulton ave attempting to make a left turn onto peninsula blvd s/w/b. mv#2 was e/b on fulton ave. mv#1 failed to yield right of way to mv#2 and came into collision with mv#2. mv#2 operator a lg white male with a beard and gray hair fleed the scene e/b on fulton. numerous open beer cans and odor of beer in mv.

I'm MV#1.

I'm really thinking of doing it. Solely on the basis of it's a once in a lifetime opportunity and I just saw it on t.v and the judge looks nice. I know that it's a stupid reason but I'll wait till my dad gets home. If the date they give me screws with my school work or anything else thats troublesome I won't do it. I know it's a very stupid reason but... I'm confused :-(

daaaam goodluck judge prob. going to be hard on u since ur 18 and they going to think well hes a new driver so he may of fucked up but at the same time a mentally ill person hit u

dude, if they do the same and guarantee the payment within 14 days, i would really consider it in that case...when i went with my cousin to court and we won our small claims...it took over 2 yrs to get the money, and probably around a 3rd of it...its really tough...or you can give it to a collection agency but they will take 33% of it...

Yeah, that was one of the benefits. I'll write down word for word what the letter said about the benefits:

I watch the Peoples Court alot (I dont have cable) -o-
So far every car accident case Ive seen, the Judge never awarded any thing over the KBB Value, unless your gonna claim pain and suffering, (but only if you did under go pain and suffering, Ex: Injuries

Was the car repairable? If your gonna go on PPL Court bring your A-Game, lol

Be Polite and dont try to lie, unless your really good, Ive seen them catch ppl in lies soooo many cases

But you might not get your 5G's only the value of the car

EX: Owner Left keys in ignition.

If the car was hot wired the owner could not have done anything to prevent it, unless the owner played a part in allowing the car to be stolen

Therefore not the owners fault,
Basically you'd be sueing the owner for living and owning the car.

but if you were to find the fucktard that stole the car and hit you you could get every penny form it

only way i think is gettin in contact with the officers that you delt with that night, tell them whats goin on or talk with you laywer first, he could probably pull more strings

That's going to be weird calling the officer. I'm sending in a complaint letter to the lieutenant. Even the other owners insurance company questioned the officer. After they obtained my claim they were like, so after this guy ran away and left beer in his car, the cop put you at fault? You're better off suing the owner like your lawyer said because we're not going to give you anything due to the police report. Not word for word but that's basically what he said. I have a question. DO you have the car still? What do you mean by "total"?

If you still have the car and fixed it, you can only sue for the amount for repair. If the car is deem a total loss by insurance, get it in writing. Then you will get KBB for it. Also the repair you listed, was this before or after the insurance? I know you are 18, but it would be easier if there was more detail, that is how the decision are made.

There a couple of scenario that can play out. If you did some suspension/brake upgrade before the accident you may not get reimburse as it would been maintainence. If it was suspension and brake modification and not legal (DOT, against the law such as too low) you might get fine and the car was actually illegal on the road. If all this was done before the accident, you get nothing but KBB.

If these repair was done after the accident to get it back on the road. You get repair $$.

Also add in pain and injury - Show medical bills.

Other than that good luck. Also I am no lawyer, but I do study tax law and work at a law firm. It pretty much the same concept how to apply stuff.

The repairs were done before the accident and they were OEM repairs. Nothing after market at all. It is deemed total loss by insurance and by 2 body shops I had the car looked at by. The frame is bent. I have a letter from insurance telling me that the car is a total loss, good thing that I didn't throw those out. I still do have the car.

Then it sounds like you are going to get KBB if you do win, not cost of repair. Because if you didnt do the repair, you KBB would been lower and you would have gotten a lower value, but the repair you did brought it back up to a higher KBB value.

You can try to argue the point and see what happens. Good luck. I would go there. Think of it as you get $250 regardless for a day. YOu are out as of now, and regardless you would be coming up $250. If you went into "real" court, you would still have to face a judge, have an assessement, have a verdict that is binding. The only difference is you would be on TV and probably wait less.
