No matter what the other driver says, you should always call the cops to get a report written. This crap always happens when someone says they will take care of it out of pocket. The leason, don't take the word of strangers. Call your insurance asap as they will most likely go after the people if they can be located.

-didnt have a drivers license

sorry to hear about it. i'd go to the police. You mentioned you got the plate number? the police can use that to find out who owns the trucks, and get in contact with him. You have a detailed story and an eye witness, he has a bad excuse with little details and is trying to run away from it. I think the cops may take your side on this one..

not calling the police is the stupidest shit you can possibly do. ive seen too many situations where the person at fault tries to turn everything around. if for watever reason you decide NOT to call police, and settle outside of insurance.. grab a sheet of paper, write down exactly what happened, adding a clause stating who was at fault, AND HAVE THE COCK SUCKERS SIGN. grab all their info.. and give them no more than one day to get what you need. you'll have a legally binding signature.. done and done.. they won't be able to fuck u as its a legally binding contract. at any rate.. call the police asap..
