My 68 mustang just got f^cking hit! Need advice.

So I was here, sitting in my room. Listening to music, and I hear tires screeching I look out my window, and I see this nissan altima skidding towards my mustang.The kids car was totally fucked up. His hood was dented inward, bumper was mis alligned and his headlights were smashed in. My car however took the impact. (Yay for old american beefy cars!)The rear QP was cracked, bumper was slight mis alligned, and alot of scratches under the bumper. Everything else was Okay.

Now..I do not have insurance on that car. I just got rid of my insurace a few weeks ago, because I was planning on selling the car. The 18 year old kid, that was driving the nissan said he just got his license a few weeks ago, and said that "everything is okay, I have full coverage on the car"...

Well...I take a few pics of my cars damage and his cars damage.
(cant upload them, because didnt pay my phone bill) Apparently that kid lives a few streets over from me. I wrote down his license and all his info.

10 Mins shortly after the accident his mom comes, and says she does deal with this by cash, and not going through insurance.

I tried calling the police, to make a non-emergency report, but when I got to them. They said they can only come if the other party was hostile about the situation. WTF?

I wrote down all her info and his info, and contact number....

Now, I've never been through this shit, so what are my options?

you should estimate the cost and ask her for the money instead of taking time to check out how much the repairs would cost and her end up flaking on you

The thing is the parts and repair for the mustang is going to be around $4000. I'm going to 3 different body shops tomorrow to get estimates. Later in the evening I will be going to their house to talk with the guy's dad.

i hope she knows what its worth or you are going to have a problem.

but i suppose everybody knows a 60s mustang when they see one.

try to get insurance on it asap. most places allow you to purchase insurance online.

but provided with the situation, the lady will be reluctant to go through insurance since her insurance will go up like crazy. be sure to NOT mention you didnt have insurance on the car

better safe than sorry however.

since there was no police report.... they(insurance or driver) can just deny your claim and say they never crashed into you at all.(dont say it cant happen because it did to me) TAKE PICS of your car and thier car. And make sure they want to pay you. Try to get things moving asap before they try to pull a fast one. Dont deal with their insurance company unless you want wait or have a chance that they can counter sue you saying that your car isnt insured and not street legal etc etc....,, were you parked in the street or your driveway?

you best bet is to talk to the moms and tell her you are going to get a estimate on repairs and if she has any objections or wants to be there or get her mechanic/body man to check it out. get estimate, give to her, negotiate a settlement.... and I believe you have 10(?) days to report an accident? not sure.... on that.... BUT if you dont settle by then you need to report it to their insurance before its too late and they deny thier/your claim because its passed the deadline....

Umm..

Thanks for the advice fella's.

So today all the body shops are closed..so I cant get a cost today.

I'm going to make some sort of documentation and have them sign it, saying they will be paying XXXX.XX amount of cash. and yada yada.

The car was parked on the street outside my house for the record.

hand them a piece of paper that simply states "i will pay for all repair costs" smoove talk them into signing it and be done with it. if they KNOW how much to expect to pay it might be a detriment to them agreeing. if you get a signature then present a bill, and they refuse hello court.

I don't believe it matters if you have no insurance?

Correct me if I'm wrong, but the party at fault is going to be liable for the damages and as long as the kid has full coverage, his insurance should be paying for the entire thing.

I've never dealt with this myself, but don't they just send an adjuster out to look at your car, and cut you a check? Or don't you just provide them with an estimate of the damages and they cut you a check?

Even if you don't have insurance, you should be fine. If you decide to take it to the insurance company, they should still pay out. From my experience, they are still at fault and still will have to pay. I'm an insurance agent for one of the top three companies here in California, and I will double check with some of the adjusters in town to double check.

you car was in the street WITHOUT INSURANCE. It's YOUR fault now. She can say she wont pay and you are fucked. This is just stupid to let a 67 mustang without insurance just to save a coupe of bucks.

He said he was selling the car thats why there was no insurance on it. The parking it on the street thing blows, at least around here, they just randomly check cars that sit on the street for insurance coverage, and sticker it if its not covered.

My advice, if they deny... get the estimates, get the pics of his car ASAP, go see Judge Judy. Or Joe Brown, or any of your choice of TV judges.

I have gotten into a wreck (with my lisence suspended and no insurance) in a wallgreens parking lot cops came took me to jail for driving with no ID or insurance but lady still had to pay my damage she was at falt could have been a child or somthing. In his case its a 60s mustang he doesnt drive so it would hold on his side in court. Falt is Falt thats why I still went to jail and she still had to pay for what she did. Big insurance company will just settle on somthing like this its a 60s mustang he could say his grandpa owned it or somthing then its worth the world not just $4000.

The system isnt there to screw you remember that.

Your car was on public road and was in an accident. Im stating the fact that in all 50 states it is illegal to have a vehicle on the streets with out insurance at any time.

As i said before, You ARE lucky she wants to handle this outside of insurance. You would have a hell of a time trying to get anything taken care of if it went that route.

If that is hard for you to understand, i can get my girl to break it down since she is an insurance agent for ya.

i got rear ended on the freeway and i didnt have insurance... we didnt do a police report either. his car was totaled. his insurance paid for my car to get fixed as well as my medical bills.

this was about 2 years ago... back before the "insurance law" came in affect though. so im not sure how it would be handled now... call up your agent on your nissan and tell ask them a "what if" scenario... or if you trust your agent (mine i know personally as we live in the same town for 10+ years) just tell him/her what happened and what would be the best thing for you to do. its too late for them to sell you insurance on the 'stang, but they shouldnt have a problem giving you advice.
