I never had those problems on motorcycles. Thier windshield dropped and I'm sure I nailed them in the face. They slammed on thier brakes and spun out. I smashed home after that.

I wanted to kill them...I hope I took one of their eyes out.

As far as the law goes, the class 4 felony is the maximum sentence for throwing an "object" at an occupied vehicle.

The way laws work in VA, and most other states/commonwealths for that matter, is like this. The legislation writes the maximum penalty into the code. It is then up to the prosecutor and the judge to exercise judicial discretion and impose a sentence somewhere between not guilty and up to the maximum sentence.

In the ice cream case , the woman only got 6 months. She could have done more than a year. I believe the situation there was that the other driver complained that his vision was impaired and had to cut across the freeway to pull over.

As for spitting, that's also a "missile". Let's pretend that you have amazing range and somehow manages to hit the driver in both eyes. The driver crashes into a school bus = 50 dead children.

I think the legislature wanted to take these situations into account so that even when small and seemingly harmless objects are thrown, the judge can decide how severe the penalty should be.

Also, 25+ over the limit or over 80+ is considered reckless = max $2,500 fine + 1 year in prison.

I have never seen anyone get the maximum sentence, just like I have never seen anyone get the maximum class 4 felony for throwing a missile. These penalties are on the books as a deterrent, and are mostly reserved for really severe cases.

Of course sentencing is always at the judge's discretion and depend on other factors.


But the general rule of thumb still hold. Don't throw anything at anybody, even if you think the object is harmless. Otherwise, you'll have to throw yourself at a judge and his/her sentencing guidelines' mercy.

AFAIK, giving the bird is still ok , but not at a government official. That's harassment and verbal assault. Who knows.

VA has a very strict judicial system... remember they're a Commonwealth (not a state, different design), and the Magistrates (instead of judges) - especially in the Va Beach area - take it upon themselves to "correct the world". By comparison, CA courts are "realists" (they call them "too lenient" and "hippies"), understanding that locking people up for little stuff only makes it worse.

When I was living in VA, I was tailed by an undercover cop with the stolen vehicles task force because a biker in my group was riding a stolen GSXR750 - we split up (before we knew we were being followed), and I later was seen passing a car on a 1 lane road (they were going about 15, I passed at 40 or so) - got lit up, shoved to the ground with a gun in my face, kicked when I reached for my concealed carry permit (I even told them I was reaching for it lol), etc.
After they found out my bike (and record) was clean they wrote me up for "25+ over Reckless" and "illegal passing", and after the judge found out I was in the Navy, I got to spend a couple weeks in Va Beach Correctional. Almost got me kicked out of the Navy (the Magistrate knew that it would), and for what?!?

I wasn't such a big fan of VA before that, and will probably never return to any Commonwealth, ever. North Carolina has all the charm and none of the prick-cops you find in VA/MD/etc.

when i lane split, i had a starbucks drink thrown at me... i don't get it sometimes... im not even cutting em off or anything.. hit me dead on but the bottum of the cup hit me so i got a little sprinkle and let it go.

other than that, my story goes like this
i was crusing on the 605 interstate, i was rolling with bout 9 other friends. me and one other guy were crusin in the carpool while the others were in the fast lane doing wheelies and what not. im minding my own business in the carpool, crusin' 70.

i started looking back frequenty, checking for coppers but the bigger GMC suvs starts coming up on my friend and i too fast. this guy must have been cm from my rear tire cus i swore i felt the heat of his engine on me. i raised my hands like WTF dude!? u don't freakin do that to a biker!! ill die in seconds if he ran me over. so i decided i didn't need that, so i lean over right to get outta his way.

next thing u know this genious floors it further to the right and speeds around me, my right mirror grazes along the entire side of his suv (from front door to rear) and nearly runs another friend over.

by this time, ive shat my pants, and im fuckin furious. my other buddies are flipping him off and im thinkin' he don't care bout that... i pull up to his side window and get a good look at him and his (might i say..) gorgeous young wife (haha). i roll around my group and line up on his back right side bout 3 car length back. i dropped the clutch and gear to third and gun it.
then, BAAAMMMMM!!! i socked his side view mirror as hard as i could! i looked back and saw the mirrow and motor shatter on the freeway, which must have ripped out, i was going least 115 into his mirror. he was doing a good 80. so.. 35mi plus the speed of my fist to the mirror could do some damage, haha. after seeing the mirror break, i kinda freaked out, said oh shit, but smiled at the same time, then boned out!! the group slowed down and the guy took off after me... i never saw him again, dont understand how an idiot driving a suv can keep up with a bike. flew off the freeway exit. waited a good minute, heard my friends ride by, caught up with them after to get some mad props..

edit: oh yea, this was last father's day... so to the douche, his hot wife, and his possible kids in the back, let that be a lesson...
so happy fathers day bitch...
